1. Acceptance of Terms

By accessing and using DadsCloud's services ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Definitions

• "Service" refers to the cloud infrastructure services provided by DadsCloud
• "User" refers to any individual or entity using our Service
• "Content" refers to all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials
• "Account" refers to your registered user account with our Service
• "DadsPoints" refers to our credit system where 1 Rupee = 1 DadsPoint

3. Service Description

DadsCloud provides hybrid cloud infrastructure services including virtual servers, storage solutions, and related services. We offer two main service models:

• Enterprise Production Services: Monthly billing for persistent infrastructure
• Flexible Learning Services: Hourly billing using DadsPoints credit system

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

4. User Accounts

4.1 Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to create an account
• One person or legal entity may not maintain more than one account without permission

4.2 Account Responsibilities

• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these terms

5. Acceptable Use Policy

5.1 Permitted Uses

You may use our Service for lawful purposes only and in accordance with these Terms.

5.2 Prohibited Uses

You may not use our Service:

• For any unlawful purpose or to solicit others to perform unlawful acts
• To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
• To transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity
• To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• For cryptocurrency mining without explicit permission
• To host or distribute malicious software, viruses, or harmful content

6. Content and Intellectual Property

6.1 User Content

• You retain ownership of content you submit to our Service
• By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content as necessary to provide the Service
• You represent that you own or have the necessary rights to all content you submit

6.2 Our Content

• All Service content, features, and functionality are owned by DadsCloud and are protected by copyright, trademark, and other laws
• You may not reproduce, distribute, modify, or create derivative works of our content without express written permission

7. Payment Terms

7.1 Fees and Billing

• Fees are charged in advance on a recurring basis for monthly services
• Hourly services are charged using DadsPoints credit system
• All fees are non-refundable except as required by law or as stated in our refund policy
• We reserve the right to change our fees at any time with 30 days' notice

7.2 Payment Methods

• You must provide current, complete, and accurate billing information
• You authorize us to charge your designated payment method for all fees
• DadsPoints can be purchased through various payment methods including UPI, bank transfer, and cards

8. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding data collection and processing.

9. Service Availability and Modifications

9.1 Availability

• We strive to maintain Service availability but do not guarantee uninterrupted access
• We may perform scheduled maintenance that temporarily interrupts Service
• Enterprise services include a 99.9% uptime SLA

9.2 Modifications

• We reserve the right to modify or discontinue the Service at any time
• We will provide reasonable notice of material changes when possible

10. Disclaimers and Limitation of Liability

10.1 Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Liability

IN NO EVENT SHALL DADSCLOUD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to defend, indemnify, and hold harmless DadsCloud from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service or violation of these Terms.

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard.

12.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

13.2 Dispute Resolution

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with Indian law.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and DadsCloud regarding the Service.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15. Changes to Terms

We reserve the right to update these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
